Statewide Ballot Efforts To Repeal Marijuana Legalization

“Sensible Marijuana Policy Act for Arizona”
On December 17, 2025, American Encore was approved to begin gathering signatures. The initiative would repeal the majority of laws and regulations enacted by Proposition 207, which legalized the possession and use of adult-use marijuana after 60.03% voters approved the measure in 2020.
House Joint Resolution 4
This joint resolution proposes an amendment to the Idaho State Constitution exclusively granting the legislature the power to legalize various activities related to psychoactive substances, including marijuana. Specifically, the amendment would prevent local governments, ballot initiatives, or other entities from legalizing the growing, producing, manufacturing, transporting, selling, delivering, dispensing, administering, prescribing, distributing, possessing, or use of such substances without direct legislative approval. The resolution mandates that this question be submitted to Idaho voters at the next general election, asking whether they support giving the legislature sole authority over the legalization of these substances:
“Shall Section 26, Article III of the Constitution of the State of Idaho be amended to provide that only the Idaho Legislature shall have power and authority to legalize the growing, producing, manufacturing, transporting, selling, delivering, dispensing, administering, prescribing, distributing, possessing, or using of marijuana, narcotics, or other psychoactive substances?”

A ballot initiative campaign is currently collecting signatures to largely repeal the state’s adult-use cannabis market. The initiative aims to eliminate commercial sales, manufacturing, and personal cultivation, and add stricter medical cannabis requirements.

A ballot initiative to repeal adult-use marijuana sales and home cultivation, has been certified by the state Elections Division. The petition has been transmitted to the legislature for further consideration. If lawmakers take no action, the measure will go before voters on Election Day.
