Geographical restrictions for UAS

LEGAL BASIS:
in addition to the limitations of its category, subcategory, in accordance with (EU) 2019/947, it is also necessary to take into account geo zones in accordance with national legislation (Regulation on the implementation of the implementing regulation of the Commission (EU) on rules and procedures for the management of unmanned aircraft.)

WARNING:
In order to ensure general safety and privacy, operations of unmanned aircraft systems are prohibited in the open category in the area of buildings and above-ground construction engineering facilities (populated) where there are people (for example, transport infrastructure facilities- roads,...).
The geographic areas listed above are drawn with an additional 'BUILT' layer. The layer is entered for information purposes and the requirements of the UAS Implementing Regulation still apply primarily.
An exception to the above prohibition applies if (all) conditions bellow are met:
- the unmanned aircraft system does not exceed a mass of 1200 grams,
- the operation is carried out up to a height of 50 meters above the ground (AGL),
- the operation is performed exclusively during the day,
- the operator obtains the approval of the owner or occupier of the property over which the flight is being carried out prior to the operation, and
- the operator submits a preliminary ANNOUNCEMENT OF FLIGHT (forms above).
When it is absolutely necessary for the safe execution of the operation and for the shortest time necessary, the unmanned aircraft during flight may be located no more than ten meters beyond the boundary of the property, for which the operator has the approval of the owner or user. GDPR (privacy) rules must be strictly followed.
